These Terms constitute the complete agreement between you and Sky Rivers ("we," "us," or "our") concerning your access to the Site and the acquisition of our Services.
1.1 Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any dispute arising out of or in connection with the Site or Services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
1.2 Changes to Terms
Sky Rivers reserves the right to review and change these Terms at any time by updating this page. Any changes take immediate effect from the date of their publication. Your continued use of the Site and Services after such changes means you accept the modified Terms.
2. Intellectual Property & Use
2.1 Site Intellectual Property
All content on the Site, including text, graphics, logos, images, and the compilation of the Site itself, is owned by Sky Rivers and protected by Australian and international copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from the Site's content without Sky Rivers' written permission.
2.2 Coaching Content & Intellectual Property
All content, materials, teachings, recordings, and intellectual property provided to you during sessions, including somatic exercises and proprietary frameworks, are subject to copyright. You are granted a limited, non-transferable license to use these materials for your own personal and non-commercial use only. You may not record, reproduce, adapt, distribute, or publish any part of the Service content without the prior written permission of Sky Rivers.
3. Terms Governing Coaching Services
These terms apply to Somatic Career Alignment sessions and other one-on-one professional coaching services.
3.1 Access and Registration
Access to Services is provided via the booking system on the Site. Access is granted upon successful payment and confirmation of the scheduled session date.
3.2 Fees and Payments
Fees are specified at the time of booking. All fees are processed through third-party payment gateways (such as Cal.com, Stripe, or PayPal). By purchasing the service, you agree to their respective terms.
3.3 Missed Sessions & Rescheduling
Your fee covers the scheduled session. It is your responsibility to attend at the agreed time.
- Rescheduling: You must provide at least 48 hours' notice if you need to reschedule a session. Rescheduling is subject to availability.
- Forfeiture: Sessions that are missed or cancelled by you with less than 48 hours' notice will be forfeited. These sessions will not be rescheduled or refunded.
- Late Arrival: If you arrive late, the session will still end at the scheduled time to respect subsequent bookings. The time lost will not be made up.
3.4 Service Refunds
No refunds will be provided once a session has commenced or the service has been delivered. Refunds for cancellations made with more than 48 hours' notice will be considered at the discretion of Sky Rivers, minus any non-refundable processing fees.
4. General Legal Provisions
4.1 General Disclaimer (Services)
Use of the Services is at your own risk. The information provided is for professional development, somatic inquiry, and career coaching only, and is provided "as is" without warranty. Sky Rivers is not a medical professional, financial advisor, or mental health counsellor. You acknowledge that you remain fully responsible for your own well-being, choices, actions, and results.
4.2 Limitation of Liability
To the extent permitted by law, Sky Rivers will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site or the use of Services. Total liability will not exceed the resupply of the Service or the cost of the session to you.
4.3 Indemnity
You agree to indemnify and hold harmless Sky Rivers from and against all actions, claims, demands, and expenses arising out of your breach of these Terms or your use of the Site and Services.
4.4 Competitors
If you are in the business of providing similar somatic career alignment services for commercial gain, you are considered a Competitor. Competitors are not permitted to use or access any proprietary content on this Website.
4.5 Privacy
Your privacy is taken seriously. Any information provided through your use of the Site or Services is subject to Sky Rivers' separate Privacy Policy, available on the Website.
4.6 Severability
If any part of these Terms is found to be void or unenforceable, that part shall be severed, and the rest of the Terms will remain in force.
